  • Vehicle Data: Vehicle Identification Number (VIN), mileage, trim level, and purchase history.

  • Claim Information: Insurance company name and the initial settlement offer amount.

  • Payment Information: Processed securely through our third-party payment processor (e.g., Stripe/Square). We do not store your full credit card details on our servers.

2. How We Use Your Information

We have a Strict Limited-Use Policy. Your data is used exclusively for:

  • Report Generation: Decoding your VIN and analyzing market metrics to build your Evidence Packet through third party websites marketcheck.com and Iseecars.com who receive it.

  • Communication: Sending your completed report and providing customer support.

  • Legal Compliance: Meeting tax and consumer protection requirements.

Our Data Guarantee: We do not sell, rent, or trade your personal information or vehicle data to insurance companies, data brokers, or third-party marketers.

3. Data Retention & Erasure

We retain your report data for a period of 12 months to allow for updates or revisions to your insurance dispute.

  • Automated Deletion: After 12 months, your specific vehicle build data is anonymized or deleted.

  • Right to Erasure: You may request immediate deletion of your data at any time by clicking the "Request Data Deletion" button in our footer or emailing info@totallossmetrics.com

4. Your 2026 Privacy Rights

Regardless of your state of residence, Total Loss Metrics honors the following consumer rights:

  • Right to Access: You may request a copy of all data we hold regarding your vehicle.

  • Right to Correct: You may update any inaccuracies in your vehicle’s build sheet or mileage.

  • Right to Opt-Out: We do not engage in "Targeted Advertising" or "Data Selling," but you retain the right to opt-out of any future secondary data uses.

  • Right to Data Portability: You may request your valuation data in a digital, machine-readable format.

5. Security Measures

We implement industry-standard AES-256 encryption for all data at rest and SSL/TLS encryption for all data in transit. Access to your vehicle data is restricted to the specialists assigned to your audit.

This section applies specifically to residents of California, Texas, Virginia, Colorado, Connecticut, Utah, and Oregon. This notice supplements our general Privacy Policy to comply with the unique requirements of your state’s consumer privacy laws (e.g., CCPA/CPRA, TDPSA, VCDPA).

1. Information We Collect & Why

In the last 12 months, we have collected the following categories of data for the purpose of providing vehicle valuation audits:

  • Identifiers: Name, email, and Vehicle Identification Number (VIN).

  • Commercial Information: Records of vehicles audited and report purchase history.

  • Geolocation: Zip Code (used only to pull local market comparables).

  • Inferences: Valuation gaps derived from our data analysis.

Note: We do not collect "Sensitive Personal Information" (such as Social Security Numbers or precise live GPS tracking) as defined by 2026 state standards.

2. Your Privacy Rights

Depending on your state of residence, you have the following rights regarding your personal information:

  • Right to Know & Access: You may request to see the specific pieces of data we have collected about you since January 1, 2022.

  • Right to Delete: You may request that we delete your data (except where we are legally required to keep it for tax or transaction records).

  • Right to Correct: You may request that we fix inaccurate vehicle or contact data.

  • Right to Opt-Out of Sale/Sharing: While we do not sell your data for money, we recognize your right to opt-out of data "sharing" for targeted ads.

  • Right to Limit Automated Decision-Making: You may opt-out of automated processing. Please note that since our audits rely on data-driven models, opting out may result in manual processing delays.

3. Designated Methods for Requests

As required by law (including the Texas Data Privacy and Security Act), we provide two secure methods for you to exercise your rights:

4. Non-Discrimination

We will not discriminate against you for exercising your privacy rights. We will verify your identity before processing any request and respond within 45 days.

By purchasing this report, you acknowledge that:  1. Total Loss Metrics LLC provides independent market data and is not an insurance company, licensed adjuster, or law firm. 2. You are responsible for submitting this data to your insurance carrier. 3. All sales are final once the VIN-specific market report has been initiated.
